Hajj Terms

  1. BOOKING YOUR HAJJ PACKAGE
  2. a) Your contract in respect of your Hajj Package is made with HMTG (SPV PVT LTD.)  , registered in Karachi Pakistan and all bookings are subject to these terms and conditions.

 

  1. a) All bookings must be made through an authorized representative of the company. At the time of booking the company booking form must be completed and submitted together with a deposit of (3000 SAR/ 1000 US dollar per person or Equitant Pakistani Currency).

 

  1. b) The Company reserves the right to refuse a booking without giving any reason and shall in that event return any deposit received.

 

  1. c) Your complete package amount must be paid before the 1st Ramadan. If payment is not received by the due date, the Company reserves the right to cancel the booking. The person who signs the booking form guarantees payment of the total amount shown on the booking form in accordance with these conditions. It is the responsibility of the signatory to ensure the Company receives payment in full by the due date.

 

  1. f) If you book within 60 days of your departure date payment must be made in full at the time of booking.

 

  1. PRICE POLICY
  2. a) The Company is under no obligation to furnish a breakdown of the costs involved in a Package.
  3. b) After a Confirmation payment receipt has been issued, unless you choose to pay for your Hajj Package in full at the time of booking, the price of your Hajj Package is subject to the open market Saudi Riyal exchange rate. If the government or regulatory body introduce new/increase taxes, so this has to be paid by Pilgrims. 
  4. c) The financial commitments offered above by the Company mean that the Company is not able to reduce the Hajj Package prices should the value of the Saudi Rial strengthen.

 

  1. CANCELLATION AND CHANGES BY THE COMPANY
  2. a) Occasionally it may be deemed necessary to make changes to your Hajj Package and the Company reserves the right to do so at any time, and you will be notified of any changes at the earliest possible opportunity. If a major change to your tour is necessary, providing it does not arise from circumstances beyond the Company’s control, you may choose (i) to accept the change of arrangements (ii) to purchase another Hajj Package from us or (iii) to cancel your Hajj Package. Compensation may be payable in cases of major change as detailed below.
  3. b) No compensation will be payable for minor changes. Minor changes include minimal changes to departure and arrival times, changes to the type of aircraft used and restaurant changes to a comparable or superior standard.
  4. c) Compensation will not be paid for changes or cancellations caused by Acts of God (Force Majeure), war, threat of war, riot, civil strike, terrorist activity, natural or man-made disaster, fire, technical problems to transport, closure or congestion of airports, strikes or other industrial action, adverse weather conditions or any other event beyond the Company’s control. It is essential that you take out adequate travel insurance.
  5. d) Transportation is subject to the conditions of carriage of the carrier, some of which may limit or exclude liability. These conditions are often the subject of international agreement between countries and copies of the conditions, which apply to your Hajj Package journey, will normally be found on the carrier’s Website.
  6. e) If you fail to pay the balance of the Hajj Package price at least 60 days before departure, the Company will treat the booking as cancelled and levy the cancellation charges set out below
  7. f) The company also has the right to refuse any person as a member of the tour, if in their opinion that person could endanger the health, safety and Ibadaat of others on the tour. 

 

  1. CANCELLATION AND CHANGES BY YOU

You may cancel your Hajj Package at any time providing you notify the Company in writing. The following charges will be levied on any cancellation:

  • 8 – 15 days before departure 80% of Package Cost
  • 1 – 7 days before departure 100% of Package Cost
  • All Airline tickets booked are non-refundable and non changeable, Airfare charges may be forfeited in case of late cancellation.
  1. OUR RESPONSIBILITIES
  2. a) The Company does not own or manage the aircraft, accommodation, buses, restaurants, Mina and Arafat Tents and other facilities used in conjunction with the tours arranged. While the Company has exercised care in selecting providers of travel, accommodation, restaurants and other facilities, the Company have not had the opportunity to inspect and do not represent that such aircraft, accommodation, restaurants, buses, Mina and Arafat Tents and other facilities and services have been inspected.
  3. b) The Company is not responsible if you or any member of your party suffer death, illness or injury as a result of any failure to perform or improper performance of any part of our contract with you where such failure is attributable to (i) the acts and/or omissions of any member of the party, or (ii) those of a third party not connected with the provision of your Hajj Package, or (iii) an event which neither the Company or the service provider could have foreseen or prevented even with due care.
  4. c) Should any member of your party suffer illness, injury or death through misadventure arising out of an activity, which does not form part of the Hajj Package the Company has arranged for you the Company cannot accept liability. The Company will offer general assistance where appropriate.
  5. d) The Company regret that no refund will be made on unused tickets where travel, sporting event or other types of ticket, unless a refund can be obtained from the carrier or provider.

 

  1. YOUR RESPONSIBILITIES
  2. a) Each member of the party must have a valid passport, visas and all necessary documentation for the countries they are touring. The Company accepts no responsibility for any delay or expense should your documents not be in order.
  3. b) You are responsible for checking-in for flights at the correct time and for presenting yourself to take up all pre-booked components of your Hajj Package. The Company cannot accept responsibility for clients missing flights as a result of late check-ins and no credit or refunds will be given if you fail to take up any component of your Hajj Package. No credit of refunds will be given for lost, mislaid or destroyed travel documents.
  4. c) By booking a Hajj Package with the Company you undertake to behave in an orderly manner and not to disrupt the worship of others on Hajj with you nor to do anything to bring the reputation of the Company into disrepute.
  5. d) It is the responsibility of the person who signs the Booking contract to disclose any pre-existing medical conditions that members of their party may have.
  6. e) All equipment and personal effects shall be all times and in all circumstances at the owner’s risk. The Company cannot accept responsibility for any loss or damage or delay to your luggage or effects unless directly caused by the negligence of one of our representatives.

 

  1. SMOKING

The Company forbids smoking in any vehicle operated by the Company. Frequent stops can be arranged for those who desire to smoke. All accommodation will be reserved with non-smoking rooms, unless the client specifically requires a smoking room. Confirmation is depending on hotel availability.

 

  1. DISCLAIMER

The Company has made all reasonable efforts to check the accuracy of the information contained in our website. The Company cannot however accept any responsibility for any errors or omissions that may appear in this site.

 

  1. COMPLAINTS
  2. a) If you have a problem during your Hajj Package, please inform the relevant airline, hotel, local agent of other suppliers immediately so that they can endeavour to put things right. If you cannot resolve the problems, you must contact the Company representative so that they are given an opportunity to help. The Company will not hold themselves responsible for the non-performance of an itinerary through causes beyond their control or when they are not notified of a problem at the point where remedial action can be taken. In the unlikely event that a complaint cannot be resolved at the time, your should write to the Company within 28 days of returning home, giving your original booking reference number and all other relevant information. If you fail to take any of these steps you will hinder the Company’s ability to put any problem right and/or investigate it fully and any right you have to receive compensation will be reduced or completely invalidated.
  3. a) Any dispute that may arise will be governed by Pakistani Law and both parties shall submit to the jurisdiction of the Pakistani Courts.
  4. b) All information given by the Company whether in writing or orally is to the best of the Company’s knowledge and believed correct at the time given and is given in good faith. The booking conditions shall take precedence over any other warranty or condition that may have been given.

 

  1. DATA PROTECTION ACT

It may be necessary for the Company to ask you for certain personal information. Examples of this would be dietary requirements, disability/medical or religious information etc. This information will be kept confidential by the Company and is available to you to inspect during the Company’s normal working hours. It will be passed to the suppliers, if it is necessary for them to know this information in order to fulfill the Company’s contract to you.

 

SPECIAL REQUESTS:

If the Client has any special requests, he should inform the Company at the time of booking. The Company and its suppliers will try to meet such requests but, as these do not form part of the Contract, the Company does not guarantee to do so, including for pre-book able seats. If the Company confirms that a special request has been noted or passed to the supplier or refers to it on the confirmation invoice or elsewhere, this is not a guarantee to meet it. The Client will not be specifically notified if a special request cannot be met. The Company does not accept bookings which are conditional on the fulfillment of any special request.

  1. AUTHORITY ON TOUR

Our group trips are run by a group coordinator. The decision of the group coordinator is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, the group coordinator may request to continue the journey but at his own risk.

STATEMENT  OF  UNDERSTANDING 

  1. It should also be known to all group members that the pilgrims are responsible for the luggage kept in the buses while traveling in Mashaire.

 

  1. It should also be well known to all group members that all the places allotted in Mashaire are from the Saudi Ministry of Hajj and KIDANA.

 

  1. This should also be known to all pilgrims that the construction of tents in Mina and Arafat, sanitation system, maintenance system, electricity system, food management, all the arrangements are in the hands of the Saudi Ministry of Hajj and all its contracts are in the hands of KIDANA
  2. It is also brought to your knowledge that Muzdalifah is a very short place to stay where more than two and a half million pilgrims have to stay for one night and all these pilgrims spend the same night. About 50,000 buses are transported from Arafat to Muzdalifah, due to the lack of space in Muzdalifah, all buses are stopped outside the limits of Muzdalifah, in which case the pilgrims have to get off their buses and walk to Muzdalifah, which can be between 700 meters and 1,000 meters.

 

  1. It is also brought to the knowledge of all the pilgrims that on the 10th of Dhu Hajj, the entry of all types of vehicles is prohibited in Mina, in this case all the pilgrims have to travel on foot and go to Jamrat to throw pebbles and you have to walk back to your residence till Azizia.

 

  1. Moreover, there is a possibility of one day difference in the entire package due to the difference in moon dates by the Saudi Ministry.

 

  1. As you all group members are well aware that Hajj is a huge gathering with delayed check-out in hotels and delayed cleaning due to which room keys are received by 5 pm.
